Algemene voorwaarden
ARTIKEL 1. Toepassingsgebied
De levering van de diensten van GOLAZO geschiedt op de hiernavolgende voorwaarden, met uitzondering van schriftelijke afwijkingen tussen partijen en zonder afbreuk te doen aan eventuele bijzondere voorwaarden overeengekomen in een afzonderlijke overeenkomst.
Onder “GOLAZO” wordt verstaan: Golazo NV, een vennootschap onder Belgisch recht, met maatschappelijke zetel te 3583 Paal-Beringen, Schoebroekstraat 8 en ingeschreven in de Kruispuntbank van Ondernemingen onder het nummer 0543.703.410, en met haar verbonden ondernemingen van de Golazo Groep, en meer in het bijzonder Golazo Sports NV, Sportizon NV en Gracias NV.
Deze voorwaarden hebben voorrang op alle andersluidende en tegengestelde voorwaarden van de klant, zelfs al worden deze naderhand meegedeeld. Zij primeren op en worden aangevuld door de voorwaarden zoals vermeld op de factuur van GOLAZO.
Zij worden geacht te zijn aanvaard door de klant behoudens diens schriftelijke en gemotiveerd, aangetekend protest binnen de vijf kalenderdagen na ontvangst. Enige eventuele nietigheid van één der onderhavige bepalingen zal geen afbreuk doen aan de toepasselijkheid van de overige bepalingen.
ARTIKEL 2. Eenzijdige wijziging
GOLAZO houdt zich het recht voor om deze algemene voorwaarden eenzijdig te wijzigen. Ze zal de klant hiervan schriftelijk op de hoogte brengen. De klant heeft het recht om binnen de 30 dagen na kennisgeving van deze wijziging de overeenkomst kosteloos te beëindigen. Indien niet, wordt hij geacht in te stemmen met de gewijzigde algemene voorwaarden.
ARTIKEL 3. Bestelling – Aanbod
Enkel een door GOLAZO schriftelijk gedaan aanbod is geldig. De geldigheidsduur van het aanbod is beperkt tot 30 dagen. De overeenkomst komt slechts tot stand na aanvaarding van de bestelling van de klant door GOLAZO.
ARTIKEL 4. Intellectuele eigendom
GOLAZO blijft de enige titularis van de intellectuele eigendomsrechten van haar creaties en organisaties. Om het even welke levering blijft eigendom van GOLAZO tot op het ogenblik der integrale betaling van de prijs.
ARTIKEL 5. Prijs
De door GOLAZO gefactureerde prijzen zijn in euro, taksen niet inbegrepen, weergegeven. De prijzen zijn steeds exclusief btw, tenzij uitdrukkelijk anders vermeld. Het wisselrisico is ten laste van de klant.
Bij een stijging van de prijs van bepaalde producten waarop GOLAZO zelf geen invloed heeft, kunnen de prijzen hieraan aangepast worden.
ARTIKEL 6. Betaling
De diensten moeten steeds vooraf worden betaald en dit via het online betalingssysteem. De bestelling is pas geldig na betaling van het volledige bedrag.
GOLAZO meent alle mogelijke en relevante voorzorgen te hebben genomen en handelt zodoende als een normale en zorgvuldige online-verkoper. Eventuele diefstal kan dan ook niet tegen haar worden ingeroepen.
ARTIKEL 7. Herroepingsrecht
De diensten vallen onder de diensten bedoeld in Art. VI, 53, 12° WER waarvoor het herroepingsrecht is uitgesloten.
ARTIKEL 8. Annulering
Elke annulering van de bestelling door de klant dient schriftelijk te gebeuren. Zij is slechts geldig mits schriftelijke aanvaarding door GOLAZO, dewelke hier op geen enkel ogenblik toe verplicht is.
ARTIKEL 9. Overmacht – Afgelasting – Aansprakelijkheid
Algemeen
GOLAZO is enkel aansprakelijk voor een aan haar toerekenbare tekortkoming, voor zover deze aansprakelijkheid niet uitdrukkelijk werd uitgesloten of beperkt in deze algemene voorwaarden. De totale aansprakelijkheid van GOLAZO is in elk geval beperkt tot vergoeding van de directe schade (met uitsluiting van indirecte schade) en kan nooit hoger zijn dan de waarde van de geleverde dienst, zijnde de prijs die het voorwerp uitmaakt van de overeenkomst.
Aansprakelijkheid in geval van overmacht is uitgesloten. Onder overmacht wordt verstaan iedere omstandigheid buiten de wil van GOLAZO om, die haar (zelfs tijdelijk) verhindert haar verplichtingen geheel of gedeeltelijk uit te voeren. Hieronder wordt onder meer begrepen (niet limitatief), niet of niet-tijdige levering of fouten van toeleveranciers of andere ingeschakelde derden, instructies, beslissingen of interventies van welke aard dan ook vanwege openbare, administratieve of regelgevende diensten (“fait du Prince”), terrorisme of dreiging met terreur, weersomstandigheden (zoals extreme hitte, onweer, storm, rukwinden, overstromingen, enz.), brand, oproer, oorlog of oorlogsdreiging, opstand, epidemie, pandemie (zoals Covid-19), staat van quarantaine, storingen in een (telecommunicatie) netwerk of verbinding of gebruikte communicatiesystemen, onlusten op de openbare weg, blokkades, stakingen of lock-outs, demonstraties en andere verstorende ongeregeldheden. Gevallen van overmacht geven geen recht op enige terugbetaling van het bestelde ticket of andere vorm van schadevergoeding.
Covid-19 en andere epidemieën en pandemieën
Covid-19 is een uiterst besmettelijke ziekte die kan leiden tot ernstige ziekte en overlijden. Een inherent risico op blootstelling aan Covid-19 bestaat op elke openbare plaats waar mensen aanwezig zijn. Aanwezigheid op het evenement is volledig vrijwillig en op eigen risico van de klant, en houdt aanvaarding in van de risico’s met betrekking tot blootstelling aan en Covid-19 en andere epidemieën en pandemieën. GOLAZO is niet aansprakelijk ingeval van het oplopen van besmetting door Covid-19 of andere epidemieën en pandemieën.
Ingeval GOLAZO het evenement niet kan laten doorgaan als gevolg van epidemie of pandemie en/of dringende overheidsmaatregelen, zal het ticket automatisch overgedragen worden naar de nieuwe datum of naar de volgende editie van het evenement.
Afgelasting
Bij afgelasting van het evenement door GOLAZO, buiten de gevallen van overmacht, zullen de tickets omgeruild worden tegen tickets voor een nieuwe/volgende editie van het evenement. Eventuele andere gemaakte kosten in verband met het evenement, zoals service- en administratiekosten, zullen niet worden terugbetaald.
ARTIKEL 10. Gezondheids- en veiligheidsmaatregelen
GOLAZO heeft de nodige gezondheids- en veiligheidsmaatregelen genomen voor het evenement, welke onderhevig kunnen zijn aan wijzigingen als gevolg van overheidsmaatregelen. De klant verklaart de van kracht zijnde maatregelen, welke op elk ogenblik door de organisatie aangepast kunnen worden aan de omstandigheden en alsdan geldende regels en overheidsmaatregelen, strikt te zullen naleven en opvolgen. Toegang tot het evenement kan afhankelijk gemaakt worden van bepaalde voorwaarden (bv. bewijs van een recente negatieve PCR-test of bewijs van volledige vaccinatie).
De klant wordt aanbevolen om het evenement niet te bezoeken ingeval van symptomen die op Covid-19 of andere epidemieën en pandemieën kunnen wijzen, zoals een grieperig gevoel, koorts, hoesten, kortademigheid, neusloop of ongewone vermoeidheid.
GOLAZO behoudt zich het recht voor om, indien van toepassing voor het betreffend evenement en zij dit nodig acht, de door de klant gekozen zitplaatsen te wijzigen en andere zitplaatsen toe te wijzen aan de klant dan deze die initieel door de klant geselecteerd werden. Wijziging van zitplaatsen zal zoveel als mogelijk gebeuren met behoud van de door de klant gekozen categorie van zitplaatsen. Ingeval een wijziging resulteert in de toewijzing van zitplaatsen waarvan de prijs lager of hoger ligt dan de door de klant betaalde prijs, dan kan GOLAZO de door de klant verschuldigde prijs aanpassen overeenkomstig de toepasselijke tarieven.
ARTIKEL 11. Klachten
Geen enkele klacht op de diensten zal aanvaard worden als zij niet per aangetekend schrijven aan GOLAZO, Schoebroekstraat 8, 3583 Beringen, wordt gericht, binnen een termijn van 8 dagen na de uitvoering van de diensten of ontdekking van enig gebrek. Bij gebreke hieraan zal de dienstverlening geacht worden aanvaard te zijn.
ARTIKEL 12. Verplichtingen
GOLAZO stelt alles in het werk om haar contractuele verplichtingen en de verwachtingen van de klant te voldoen. Zij kan evenwel enkel gehouden zijn tot een middelenverbintenis.
ARTIKEL 13. Persoonsgegevens
De klant verleent GOLAZO hierbij de toestemming om alle in het kader van de relatie tussen partijen uitgewisselde persoonsgegeven te verzamelen en op te nemen in een bestand voor commercieel – administratieve doeleinden en met het oog op directe mailing. GOLAZO zal zorgen dat alle wettelijke formaliteiten zijn vervuld en dat de klant overeenkomstig de Algemene Verordening Gegevensverwerking 2016/679 van 27 april 2016 i.v.m. de bescherming van de persoonlijke levenssfeer t.o.v. gegevensverwerking, recht heeft op toegang tot de gegevens en het verbeteren ervan, waartoe te allen tijde verzocht kan worden via de contactgegevens opgenomen in deze algemene voorwaarden. ARTIKEL 14. Solidariteit
In geval van meerdere klanten, zijn zij hoofdelijk aansprakelijk voor hun diverse verplichtingen en worden zij verondersteld afstand te hebben gedaan van de voordelen van verdeling en betwisting.
ARTIKEL 15. Uitvoeringsmodaliteiten
Het transportrisico en de port- en leveringskosten zijn exclusief ten laste van de klant.
ARTIKEL 16. Uitvoeringstermijn
Enkel de termijnen schriftelijk aangegeven door GOLAZO zijn bindend. Deze termijnen zullen in ieder geval verlengd worden in geval van overmacht, wijziging van de bestelling door de cliënt, vertraging in het overmaken van informatie en/of documenten door de cliënt of vertraging door betaling.
ARTIKEL 17. Toepasselijk recht
De overeenkomsten tussen GOLAZO en de klant zijn onderworpen aan het Belgisch recht. Alle geschillen vallen onder de uitsluitende bevoegdheid van de rechtbanken van de maatschappelijke zetel van GOLAZO.

Conditions générales
ARTICLE 1. Champ d’application
Sauf dérogations écrites convenues entre les parties et sans préjudice d’éventuelles conditions particulières convenues dans un contrat séparé, la prestation de services par GOLAZO, à laquelle le présent bon de commande se réfère, se fait aux conditions suivantes.
On entend par « GOLAZO » : Golazo NV, société de droit belge ayant son siège social à 3583 Paal-Beringen, Schoebroekstraat 8 et enregistrée auprès de la Banque Carrefour des Entreprises sous le numéro 0543.703.410, et ses sociétés affiliées du groupe Golazo, et plus précisément Golazo Sports NV, Sportizon NV et Gracias NV.
Les conditions générales l’emportent sur toutes les conditions autres ou contraires du client, même si celles-ci sont communiquées postérieurement. Ces conditions prévalent et sont complétées par les conditions stipulées sur la facture de GOLAZO.
Elles sont réputées avoir été acceptées par le client sauf contestation écrite, motivée et recommandée de la part de ce dernier dans les cinq jours calendrier suivant la réception. La nullité éventuelle d’une des présentes dispositions n’influence en aucun cas la validité des autres dispositions.
ARTICLE 2. Modification unilatérale
GOLAZO se réserve le droit de modifier unilatéralement ces conditions générales. Elle en informera le client par écrit. Le client a le droit de résilier le contrat sans frais dans les 30 jours calendrier suivant la notification de ce changement. Sinon, il sera réputé avoir accepté les conditions générales telles qu’elles auront été modifiées.
ARTICLE 3. Commande – Offre
Seule une offre écrite de GOLAZO est valide. La durée de validité de l’offre est limitée à 30 jours. Le contrat n’est conclu qu’après acceptation de la commande du client par GOLAZO.
ARTICLE 4. Propriété intellectuelle
GOLAZO reste le titulaire unique des droits de propriété intellectuelle sur ses créations et organisations. Chaque livraison demeure propriété de GOLAZO jusqu’à paiement intégral du prix.
ARTICLE 5. Prix
Les prix sur les factures émises par GOLAZO sont libellés en euro, taxes non comprises. Les prix s’entendent toujours TVA non comprise, sauf indication contraire. Le risque de change est à charge du client.
En cas d’augmentation du prix de certains produits sur lesquels GOLAZO n’a elle-même aucune influence, les prix peuvent être ajustés en conséquence.
ARTICLE 6. Paiement
Les services doivent toujours être payés au préalable et cela via le système de paiement en ligne. La commande n’est valable qu’après paiement de l’entièreté du montant.
GOLAZO affirme avoir pris toutes les précautions possibles et agit ainsi en tant que vendeur en ligne normal et prudent. Tout vol ne peut donc pas lui être incombé.
ARTICLE 7. Droit de rétractation
Les services tombent sous les services visés par l’Art. VI, 53, 12° CDE desquels le droit de rétractation est exclu.
ARTICLE 8. Annulation
Toute annulation d’une commande par le client doit être effectuée par écrit. Elle n’est valable qu’après avoir été acceptée par écrit par GOLAZO.
ARTICLE 9. Force majeure – Annulation de l’événement – Responsabilité
Général
GOLAZO n’est responsable que d’une faute qui lui est imputable, dans la mesure où cette responsabilité n’a pas été explicitement exclue ou limitée dans les présentes conditions générales. La responsabilité totale de GOLAZO est en tout état de cause limitée à l’indemnisation des dommages directs (hors dommages indirects) et ne peut jamais être supérieure à la valeur de la prestation fournie, à savoir les frais d’inscription.
La responsabilité en cas de force majeure est exclue. Par force majeure, on entend toute circonstance échappant au contrôle de GOLAZO qui l’empêche (même temporairement) de remplir ses obligations en tout ou en partie. Cela comprend (non exhaustif), la non-livraison ou la livraison tardive ou les erreurs de fournisseurs ou d’autres tiers contractés, les instructions, les décisions ou les interventions de quelque nature que ce soit d’une autorité publique, administrative ou réglementaire («fait du Prince»), le terrorisme ou la menace terroriste, conditions météorologiques (telles que chaleur extrême, orage, tempête, rafales, inondations, etc.), incendie, émeute, guerre ou menace de guerre, insurrection, épidémies, pandémies (comme COVID-19), état de quarantaine, perturbations dans un réseau ou une connexion (télécommunications) ou connexion ou systèmes de communication utilisés, émeutes sur la voie publique, les barrages, les grèves ou les lock-out, les manifestations et autres perturbations inquiétantes. Les cas de force majeure ne donnent droit à aucun remboursement des frais d’inscription ou autre forme de compensation.
Covid-19 et autres épidémies et pandémies
Le Covid-19 est une maladie extrêmement contagieuse qui peut mener à être gravement malade et au décès. Un risque inhérent d’exposition au Covid-19 existe dans tout lieu public où des personnes sont présentes. La présence à l’événement est totalement volontaire et aux propres risques du participant, et implique l’acceptation des risques liés à l’exposition au Covid-19 et autres épidémies et pandémies. L’organisateur n’est pas responsable en cas de contamination au Covid-19 ou et autres épidémies et pandémies.
Dans le cas où l’organisateur ne peut laisser l’événement se dérouler en raison d’une épidémie ou pandémie et/ou de mesures gouvernementales urgentes, l’inscription sera automatiquement transférée à la nouvelle date ou à l’édition suivante de l’événement.
Annulation
En cas d’annulation de l’événement par GOLAZO, hors les cas de force majeure, les billets seront échangés contre des billets pour une nouvelle/prochaine édition de l’événement. Tous les autres frais engagés dans le cadre de l’événement, tels que les frais de service et d’administration, ne seront pas remboursés.
ARTICLE 10. Mesures de santé et de sécurité
GOLAZO a pris les mesures sanitaires et de sécurité nécessaires à l’événement, lesquelles peuvent être modifiées en fonction des mesures gouvernementales. Le client déclare respecter strictement les mesures en vigueur, lesquelles peuvent être adaptées à tout moment par l’organisateur en fonction des circonstances et des règles mesures gouvernementales applicables. L’accès à l’événement peut être soumis à certaines conditions (par exemple, la preuve d’un test PCR négatif récent ou la preuve d’une vaccination complète).
Il est recommandé au client de ne pas visiter l’événement en cas de symptômes rappelant ceux du Covid-19 ou autres épidémies et pandémies, comme un état grippal, de la fièvre, une toux, un essoufflement, un nez qui coule ou une fatigue inhabituelle.
GOLAZO se réserve le droit, si elle le juge nécessaire, de modifier les sièges choisis par le client et d’attribuer au client d’autres sièges que ceux initialement choisis par le client. Les changements de sièges seront effectués dans la mesure du possible en conservant la catégorie de sièges choisie par le client. Si une modification entraîne l’attribution de places dont le prix est inférieur ou supérieur au prix payé par le client, GOLAZO pourra ajuster le prix dû par le client conformément aux tarifs applicables.
ARTICLE 11. Réclamations
Aucune réclamation concernant les services ne sera acceptée si elle n’est pas adressée par lettre recommandée à GOLAZO, Schoebroekstraat 8 ; 3583 Beringen, dans les 8 jours calendrier suivant la prestation de services ou la découverte d’un défaut. À défaut, la prestation de services sera réputée avoir été acceptée.
ARTICLE 12. Obligations
GOLAZO met tout en œuvre pour exécuter ses obligations contractuelles et satisfaire aux attentes du client. Cependant, elle n’est tenue que par une obligation de moyens.
ARTICLE 13. Données personnelles
Le client autorise GOLAZO à conserver toutes les données personnelles échangées dans le cadre de la relation entre les parties et à les intégrer dans un fichier à des fins commerciales et administratives et en vue de mailings directs. GOLAZO veillera à ce que toutes les formalités légales soient accomplies et à ce que le client bénéfice, conformément au Règlement Général sur la Protection des Données 2016/679 relative à la protection de la vie privée à l’égard des traitements de données à caractère personnel, le droit d’accès aux données traitées et leur correction, lequel le client peut demander à tout moment en utilisant les données de contact reprises dans les présentes conditions générales. ARTICLE 14. Solidarité
Dans le cas de plusieurs clients, ils sont solidairement responsables de leurs différentes obligations et sont présumés avoir renoncé aux avantages de la division ainsi qu’à la contestation.
ARTICLE 15. Modalité d’exécution
Les risques du transport ainsi que les frais de port et de livraison sont exclusivement à la charge du client.
ARTICLE 16. Délai d’exécution
Seules les périodes explicitement écrites par GOLAZO sont contraignantes. Ces périodes seront dans tous les cas prolongées en cas de force majeure, de modification de la commande par le client, de retard dans le transfert d’information et/ou documents par le client ou de retard de paiement.
ARTICLE 17. Droit applicable – juridiction
Les contrats entre GOLAZO et le client sont régis par le droit belge. Tous les litiges sont de la compétence exclusive des tribunaux du siège social de GOLAZO.

General conditions
ARTICLE 1. Applicability
The delivery of the services of GOLAZO, based on the following terms, excluding written discrepancies between the parties and without prejudice to any special conditions agreed in a separate agreement.
“GOLAZO” shall mean: Golazo NV, a company governed by Belgian law, with registered office at 3583 Paal-Beringen, Schoebroekstraat 8 and registered in the Central Database for Enterprises under number 0543.703.410, and its affiliated companies of the Golazo Group, and more specifically Golazo Sports NV, Sportizon NV and Gracias NV.
These conditions take precedence over any contrary and conflicting conditions of the customer, even if these are communicated afterwards. They take precedence over and are supplemented by the terms stated on the invoice GOLAZO.
They are deemed to have been accepted by the client unless written and registered protest is lodged within five calendar days of receipt. Any invalidity of any of these provisions will not affect the applicability of the other provisions.
ARTICLE 2. Unilateral change
GOLAZO holds the right to amend these terms and conditions unilaterally. The customer will be notified in writing. The customer has the right to terminate the agreement free of charge within 30 days of notification of this change. If not, he will be deemed to agree to the amended terms and conditions.
ARTICLE 3. Order – offer
Only a written offer by the GOLAZO is valid. The validity of the offer is limited to 30 days. The agreement is made only after acceptance of the order of the customer by GOLAZO.
ARTICLE 4. Intellectual property
GOLAZO remains the sole holder of the intellectual property rights for its creations and organizations. Any delivery remains the property of GOLAZO until the moment of full payment of the price.
ARTICLE 5. Price
The prices invoiced by the GOLAZO, are in euros and exclude taxes. The prices are exclusive of VAT, unless explicitly stated otherwise. The exchange risk is borne by the customer.
When a price increase occurs of certain products outside of the control of GOLAZO, prices can be adjusted accordingly.
ARTICLE 6. Payment
The service must always be paid in advance and this through the online payment system. The order is only valid after payment of the full amount.
GOLAZO claims to have taken full and appropriate care and thus acts as a normal and careful online seller. Any theft cannot therefore be invoked against it.
ARTICLE 7. Right of withdrawal
The services covered by the services referred to in Art. VI, 53, 12 ° WER of which the right of withdrawal is excluded.
ARTICLE 8. Cancellation
Any cancellation of the order by the customer must be in writing. It is only valid if when written acceptance has been sent by GOLAZO, who is not obliged to do so at any given time.
ARTICLE 9. Force Majeure – Cancellation – Liability
General
GOLAZO is only liable for a shortcoming attributable to it, insofar as this liability has not been explicitly excluded or limited in these general terms and conditions. In aggregate, the liability of GOLAZO is in any case limited to compensating for direct damage (excluding indirect damage) and can never be in excess of the value of the service provided, being the registration fee.
Liability in the event of force majeure is excluded. Force majeure is understood to include any and all circumstances or events which are beyond the control of GOLAZO that prevent it (even temporarily) from fulfilling its obligations in whole or in part. This includes, but is not limited to, non-delivery or late delivery or errors from suppliers or other engaged third parties, instructions, decisions or interventions of any kind by public or regulatory authorities (“fait du Prince”), terrorism or the threat of terror, weather conditions (such as extreme heat, thunder, storm, gusts, floods, etc.), fire, riot, war or threat of war, uprising, epidemics, pandemics (such as COVID-19), state of quarantine, disruptions in a (telecommunications) network or connection or used communication systems, riots on the public highway, blockades, strikes or lock-outs, demonstrations and other disturbing disturbances. Cases of force majeure do not give the right to any reimbursement of the registration fee or any other form of compensation for damages.
Covid-19 and other epidemics and pandemics
Covid-19 is an extremely contagious disease that can lead to serious illness and death. An inherent risk of exposure to Covid-19 exists in any public place where people are present. Attending the event is entirely voluntary and at the participant’s own risk and implies acceptance of the risks associated with exposure to Covid-19 and other epidemics and pandemics. GOLAZO shall not be liable in any way in case of contamination with Covid-19 or other epidemics and pandemics.
If GOLAZO has to cancel the event due to an epidemic or pandemic and/or emergency government measures, the registration will automatically be transferred to the new date or the next edition of the event.
Cancellation
In case of cancellation of the event by GOLAZO, other than in the event of force majeure, the tickets will be exchanged for tickets for a new / next edition of the event. Any other costs incurred in connection with the event, such as service and administration costs, will not be reimbursed.
ARTIKEL 10. Health and safety precautions
GOLAZO has provided the necessary health and safety precautions for the event, which may be subject to adjustments due to governmental measures. The customer undertakes to strictly comply with the applicable measures, which may, at any time, be adjusted by the organisation in function of the circumstances and the then applicable regulations and governmental measures. Access to the event may be subject to specific conditions (e.g. proof of recent negative PCR-test or proof of full vaccination).
It is recommended that customers do not visit the event when showing symptoms that might indicate Covid-19 or other epidemics and pandemics, such as feeling feverish, fever, cough, shortness of breath, running nose or unusual fatigue.
GOLAZO reserves the right, if it deems it necessary, to modify the seats chosen by the customer and to allocate to the customer other seats than those initially selected by the customer. In case of changes of seats, the category of seats chosen by the customer shall be maintained where possible. If a change results in the allocation of seats of a price lower or higher than the price paid by the customer, GOLAZO may adjust the price paid by the customer to the price of the allocated seats.
ARTICLE 11. Complaints
No complaint to the services will be accepted if they are not sent by registered mail to GOLAZO, Schoebroekstraat 8, 3583 Beringen, within 8 days after the execution of the services or discovery of any defect. Failing this it will be deemed to be accepted services.
ARTICLE 12. Duties
GOLAZO is making every effort to meet its contractual obligations and the expectations of the customer. However, they can only be held to an obligation of means.
ARTICLE 13. Personal data
The customer hereby grants permission to GOLAZO in the context of the relationship between the parties to collect personal data and incorporate it into a file for commercial – administrative purposes and for the purpose of direct mailing. GOLAZO will ensure that all legal formalities have been completed and that the customer, in accordance with the General Data Protection Regulation 2016/679 relating to data processing lays down the access right to the data and the correction thereof, is entitled to access and correct the data processed. At all times the customer can request the correction of his/her personal data based on the contact details specified in these general terms and conditions. ARTICLE 14. Solidarity
In case of multiple clients, they are jointly and severally liable for their various obligations and they are supposed to have done away with the benefits of division and dispute.
ARTICLE 15. Implementation modalities
The transport risk and the postage and delivery costs are exclusively borne by the client.
ARTICLE 16. Period
Only the periods indicated in writing by GOLAZO are binding. These periods will be extended at least in cases of force majeure, changes to the order by the client, delay in the transfer of information and / or documents submitted by the client or delay payment.
ARTICLE 17. Applicable law – jurisdiction
The agreements between GOLAZO and the client are subject to Belgian law. All disputes are subject to the exclusive jurisdiction of the courts of the registered office of GOLAZO.
