U schrijft zich in voor deelname aan een evenement van GOLAZO SPORTS NV, met maatschappelijke zetel te Schoebroekstraat 8, 3583 Paal-Beringen, BTW BE 0442.115.211, hierna “GOLAZO” of “de organisator”.

Artikel 1. Inschrijving
De deelnemer verklaart op het moment van inschrijving min. 18 jaar te zijn of de toestemming van zijn wettelijke voogd te hebben om zich in te schrijven voor het evenement.
De inschrijving is slechts geldig indien het inschrijvingsformulier volledig en naar waarheid is ingevuld, het inschrijvingsgeld en betaling voor extra’s volledig is voldaan en deze algemene voorwaarden zijn aanvaard.
Artikel 2. Herroepingsrecht
De inschrijving valt onder de diensten bedoeld in Art. VI, 53, 12° WER waarvoor het herroepingsrecht is uitgesloten. In geval van niet-deelname, ongeacht om welke reden, kan er geen aanspraak gemaakt worden op de terugbetaling van het inschrijvingsgeld en eventuele extra’s.
Artikel 3. Opbergruimte
Deelname aan een evenement en betreding van het evenemententerrein geschiedt op eigen risico. De organisator kan een opbergruimte voorzien waar de deelnemer vrijblijvend en kosteloos persoonlijke spullen kan achterlaten. De organisator zal alle redelijke veiligheidsmaatregelen nemen om de ruimte zo goed mogelijk te bewaken, doch gebruik ervan is op eigen risico. De organisator raadt de deelnemer af om waardevolle spullen mee te nemen of op te bergen. De organisator is in geen geval aansprakelijk voor gebeurlijke schade aan of verlies of diefstal van bezittingen van de deelnemer.
Artikel 4. Deelname
Deelname aan een evenement kan enkel met een geldige inschrijving en indien aan de leeftijdsvereisten is voldaan. De organisator behoudt zich het recht voor om deelnemers die de bepalingen uit deze algemene voorwaarden niet respecteren of een gevaar vormen voor zichzelf of voor derden, uit te sluiten van deelname.
Voor bepaalde evenementen kunnen er afwijkende leeftijdsvereisten gelden en dient het toepasselijke reglement van het evenement geraadpleegd te worden op de eventwebsite.
Wandelevenementen
Deelnemers jonger dan 12 jaar kunnen slechts deelnemen onder begeleiding van een persoon ouder dan 18 jaar
Vanaf 25 km: minimum 12 jaar op het moment van deelname
Vanaf 50 km: minimum 16 jaar op het moment van deelname
Loopevenementen
Vanaf 10km: min. 12 jaar op het moment van deelname
Vanaf 21km: min. 16 jaar op het moment van deelname
Vanaf 42km: min. 18 jaar op het moment van deelname
Fietsevenementen
Deelnemers jonger dan 16 jaar moeten steeds vergezeld zijn van een persoon ouder dan 18 jaar.
Op fietsevenementen zal de deelnemer steeds een valhelm dragen. De wegcode dient gerespecteerd te worden.
Tijdens de deelname moet het bewijs van inschrijving (borstnummer, stuurnummer, polsbandje, …) steeds zichtbaar zijn.
De deelnemer zal steeds respect hebben voor het milieu. De deelnemer waakt over zijn eigen veiligheid en die van de andere deelnemers. Deelnemers dienen de instructies van de organisator, medische teams en politie te volgen.
Artikel 5. Prijzen
De vermelde prijzen zijn steeds in euro uitgedrukt en inclusief btw, tenzij uitdrukkelijk anders vermeld.
Artikel 6. Betaling
De deelnemer dient steeds vooraf, bij inschrijving, het volledige bedrag van de inschrijving (inschrijvingsgeld en extra’s) te betalen en dit via het voorziene online betalingssysteem.
Artikel 7. Wijziging van de inschrijving
Deelnemers die hun inschrijving voor een evenement willen doorgeven aan een ander persoon kunnen hiervoor telefonisch contact nemen met GOLAZO (elke werkdag tussen 9u en 17u via telefoonnr. 011/45.99.00) of kunnen dit op de dag van het evenement ter plaatse. In geval van wijziging van inschrijving ter plaatse betalen deelnemers hiervoor een administratieve kost.
Deelnemers die van afstand willen wisselen kunnen, indien de gewenste afstand niet volzet is, hiervoor telefonisch contact nemen met GOLAZO of dit ter plaatse vragen op de dag van het evenement. In geval van wijziging van afstand ter plaatse betalen deelnemers hiervoor een administratieve kost. Indien voor de nieuwgekozen afstand een meerprijs geldt, zal die ook worden aangerekend. Een eventuele minprijs komt niet in aanmerking voor terugbetaling gezien een inschrijving niet herroepbaar is.
Het is niet mogelijk om een inschrijving voor een evenement in te wisselen voor een andere editie van dat evenement, noch voor een ander evenement van de organisator.
Artikel 8 Aanbevelingen gezond & veilig sporten
Deelnemen vereist een goede gezondheid en een goede conditionele voorbereiding. De deelnemer verklaart te voldoen aan deze voorwaarde. De organisator beveelt voor deelname een preventief sportmedisch onderzoek aan bij een erkend sportarts.
De organisator heeft de nodige gezondheids- en veiligheidsmaatregelen genomen voor het evenement. De deelnemer verklaart de van kracht zijnde maatregelen, welke op elk ogenblik door de organisator aangepast kunnen worden aan de omstandigheden en alsdan geldende regels, strikt te zullen opvolgen.
De deelnemer wordt aanbevolen om niet aan het evenement deel te nemen ingeval van symptomen die op een besmettelijke ziekte kunnen wijzen, zoals een grieperig gevoel, koorts, hoesten, kortademigheid, neusloop of ongewone vermoeidheid. Risicogroepen worden afgeraden om deel te nemen aan het evenement.
Artikel 9. Verzekering – Overmacht – Aansprakelijkheid
Persoonlijke ongevallen (lichamelijke schade) van deelnemers aan een evenement zijn gedekt door een collectieve ongevallenverzekering die inbegrepen is in het inschrijvingsgeld.
Elke gebeurtenis die plaatsvindt buiten de wil en controle van de organisator en waaraan deze zich redelijkerwijze niet kon verwachten, en die de organisator (zelfs tijdelijk) verhindert om haar verplichtingen geheel of gedeeltelijk uit te voeren, maakt een situatie van overmacht uit. Hieronder wordt onder meer begrepen (niet limitatief), instructies, beslissingen of interventies van welke aard dan ook vanwege openbare, administratieve of regelgevende diensten (“fait du Prince”), terrorisme of dreiging met terreur, weersomstandigheden (zoals extreme hitte, onweer, storm, rukwinden, overstromingen, enz.), brand, oproer, oorlog of oorlogsdreiging, opstand, epidemie, pandemie (zoals covid-19) of andere besmettelijke ziekten, staat van quarantaine, niet-levering of te late levering of fouten van toeleveranciers of andere ingeschakelde derden (met uitsluiting van hun opzettelijke fout en grove schuld), storingen in een (telecommunicatie) netwerk of verbinding of gebruikte communicatiesystemen, onlusten op de openbare weg, blokkades, stakingen of lock-outs, demonstraties en andere verstorende ongeregeldheden. De organisator is niet aansprakelijk voor gevallen van overmacht, dewelke geen recht geven op terugbetaling van het inschrijvingsgeld of enige andere vorm van schadevergoeding. De organisator zal in geval van overmacht binnen een redelijke termijn bekijken of een eventuele compensatie voor de deelnemer – bv. omruiling van het ticket voor een ticket van de nieuwe/volgende editie van het evenement of ander evenement van GOLAZO – mogelijk is, afhankelijk van de omstandigheden. Eventuele andere gemaakte kosten in verband met het evenement, zoals service- en administratiekosten en eventuele extra’s (zoals o.a. merchandising, T-shirts, trainingsschema, goede doel, …) komen niet in aanmerking voor terugbetaling.
GOLAZO is aansprakelijk voor aan haar toerekenbare tekortkomingen. Indien enige aansprakelijkheid van GOLAZO voor schade aangenomen moet worden, dan zal de verplichting van GOLAZO tot vergoeding van de schade beperkt zijn tot maximaal het bedrag dat betaald is voor de geleverde diensten, zijnde het inschrijvingsgeld, met uitsluiting van indirecte schade (met inbegrip van gevolgschade, verlies van winst of gemiste kans, enz.). Deze aansprakelijkheidsbeperking geldt niet ingeval van schade die is veroorzaakt door opzettelijke fout, grove schuld en/of bedrog van GOLAZO, of voor enige andere aansprakelijkheid die ingevolge toepasselijke wetgeving niet kan worden uitgesloten of beperkt.
De deelnemer doet afstand van een rechtstreekse buitencontractuele vordering opzichtens hulppersonen van de organisator (waaronder bestuurders, werknemers, vertegenwoordigers en freelancers) in de zin van artikel 6.6 Burgerlijk Wetboek ingeval van fouten van hulppersonen welke aanleiding zouden kunnen geven tot dergelijke vordering zoals bedoeld in artikel 6.3 Burgerlijk Wetboek, en zal zich voor eventueel geleden schade exclusief tot GOLAZO te richten. Deze afstand van vordering geldt niet in geval van opzettelijke fout, grove schuld en/of bedrog van de hulppersonen, of ingeval de fout een misdrijf uitmaakt.
Bij afgelasting van het evenement door GOLAZO, buiten gevallen van overmacht, zal het ticket omgeruild worden voor een ticket voor de nieuwe/volgende editie van het evenement of ander evenement van GOLAZO.
Artikel 10. Persoonsgegevens
Alle informatie van de deelnemers is bestemd voor GOLAZO. GOLAZO en haar partners zullen deze gegevens gebruiken voor de deelname van het Event alsook voor marketing en communicatiedoeleinden. De Algemene Verordening Gegevensverwerking 2016/679 van 27 april 2016 i.v.m. de bescherming van de persoonlijke levenssfeer t.o.v. gegevensverwerking, voorziet het toegangsrecht tot de gegevens en het verbeteren ervan. De deelnemer kan te allen tijde vragen om verbetering van zijn persoonsgegevens, via de contactgegevens opgenomen in deze algemene voorwaarden.
Door uw deelname aan het event verklaart u zich akkoord met een eventueel gebruik van uw gegevens, foto of portretrecht in druk, film, video e.a. voor promotionele doeleinden van GOLAZO en haar events, zonder hiervoor een vergoeding te claimen.
De deelnemer verklaart zich bekend met het feit dat er gebruik kan worden gemaakt van technieken die het mogelijk maken om op ieder gewenst moment zijn/haar precieze locatie te achterhalen door het opvangen van signalen van de chip, opgenomen in het bewijs van deelname dat de deelnemer draagt. De deelnemer verleent de toestemming aan GOLAZO om deze informatie openbaar te maken, zodat deze door iedereen kan worden gezien.
De deelnemer verleent toestemming aan GOLAZO zijn locatie realtime te volgen (live tracking) op een wijze als hiervoor omschreven, om deze gegevens op te nemen in een bestand, te verstrekken aan derden en te publiceren via internet, via social media en via mobiele applicaties.
Artikel 11. Opmerkingen/klachten
Opmerkingen dienen ingediend te worden via één van in de aanhef vermelde kanalen. GOLAZO zal steeds in alle redelijkheid proberen om elke opmerking te behandelen en dit binnen de 10 dagen na ontvangst via één van bovenvermelde kanalen. Indien dit niet lukt, zal dit eveneens aan de deelnemer worden gemeld en een alternatief tijdsverloop worden voorgesteld.
Artikel 12. Geldigheid clausules
Indien één of enkele artikels van deze voorwaarden nietig of onwettig zouden zijn, om welke reden dan ook, doet dit geen afbreuk aan de geldigheid van de andere onderdelen van de voorwaarden.
Artikel 13. Toepasselijk recht – Bevoegdheid
Op deze algemene voorwaarden is Belgisch recht van toepassing. Ingeval van geschillen m.b.t. deze algemene voorwaarden zijn uitsluitend de rechtbanken van het rechtsgebied van de zetel van GOLAZO bevoegd.

Article 1. Inscription
Le participant déclare avoir, au moment de l’inscription, au moins 18 ans ou le consentement de son tuteur légal pour s’inscrire à l’événement.
L’inscription n’est valable que si le formulaire d’inscription est dûment rempli et que toutes les informations sont exactes, que le droit d’inscription a été payé en totalité, que le paiement intégral des frais supplémentaires a été effectué, et que les présentes conditions générales ont été acceptées.
Article 2. Droit de rétractation
L’inscription relève des services visés à l’art. VI, 53, 12° CDE, qui exclut le droit de rétractation. En cas de non-participation, pour quelque raison que ce soit, la personne inscrite n’a pas droit au remboursement des droits d’inscription et de tous les frais supplémentaires.
Article 3. Espace de stockage
La participation à un événement et l’entrée sur le site de l’événement se font à propre risque du participant. L’organisateur peut mettre à disposition un espace de stockage où le participant peut laisser gratuitement et sans obligation ses effets personnels. L’organisateur prendra toutes les mesures de sécurité raisonnables pour garder l’espace le mieux possible, mais son utilisation se fait à propre risque du participant. L’organisateur conseille au participant de ne pas apporter ou stocker des objets de valeur. L’organisateur n’est en aucun cas responsable de tout dommage, perte ou vol des effets personnels du participant.
Article 4. Participation
La participation à l’événement n’est possible que si l’inscription est valable et qu’il est satisfait aux conditions d’âge. L’organisateur se réserve le droit d’exclure de la participation à l’événement les participants qui ne respectent pas les dispositions des présentes conditions générales ou qui représentent un danger pour eux-mêmes ou pour des tiers.
Pour certains événements, des conditions d’âge différentes peuvent s’appliquer, et le règlement applicable à l’événement doit être consulté sur le site web de l’événement.
Événements de randonnée
Les participants de moins de 12 ans doivent toujours être accompagnés d’une personne de plus de 18 ans.
À partir de 25 km : min. 12 ans au moment de la participation
À partir de 50 km : min. 16 ans au moment de la participation
Événements de course
À partir de 10 km : min. 12 ans au moment de la participation
À partir de 21 km : min. 16 ans au moment de la participation
À partir de 42km : min. 18 ans au moment de la participation
Événements de cyclisme
Les participants de moins de 16 ans doivent toujours être accompagnés d’une personne de plus de 18 ans.
Lors d’événements de cyclisme, le participant devra toujours porter un casque. Le code de la route doit être respecté.
Au cours de la participation, la preuve de l’inscription (numéro de dossard, numéro sur le guidon, bracelet, etc.) doit toujours être visible.
Le participant devra toujours se montrer respectueux de l’environnement. Le participant veille à sa propre sécurité et à celle des autres participants. Les participants doivent suivre les instructions des organisateurs, des équipes médicales et de la police.
Article 5. Prix
Les prix mentionnés sont toujours exprimés en euros et s’entendent TVA comprise, sauf indication contraire.
Article 6. Paiement
Le participant doit toujours payer d’avance, lors de son inscription, le montant total de l’inscription (droit d’inscription et suppléments) en utilisant le système de paiement en ligne mis à disposition.
Article 7. Modification de l’inscription
Les participants qui souhaitent céder leur inscription pour un événement à une autre personne peuvent contacter GOLAZO par téléphone (tous les jours ouvrables entre 9h00 et 17h00 au numéro de téléphone 011/45.99.00) ou peuvent le faire sur place, le jour de l’événement. En cas de changement d’inscription sur place, les participants devront payer des frais administratifs.
Les participants qui souhaitent changer de distance peuvent, si la distance désirée n’est pas complète, contacter GOLAZO par téléphone ou peuvent le demander sur place, le jour de l’événement. En cas de changement de distance sur place, les participants devront payer des frais administratifs. Si un supplément s’applique à la nouvelle distance choisie, celui-ci sera également chargé. Toute minoration de prix ne peut faire l’objet d’un remboursement car l’inscription n’est pas révocable.
Il n’est pas possible d’échanger une inscription à un événement pour une autre édition de cet événement, ni pour un autre événement de l’organisateur.
Article 8. Faire du sport sainement & en toute sécurité
La participation à un événement sportif nécessite une bonne santé et une bonne préparation conditionnelle. Le participant déclare satisfaire à cette condition. L’organisateur recommande un examen préventif de médecine du sport auprès d’un médecin du sport agréé en vue d’une participation à un événement sportif.
L’organisateur a pris les mesures sanitaires et de sécurité nécessaires à l’événement. Le participant déclare respecter strictement les mesures en vigueur, lesquelles peuvent être adaptées à tout moment par l’organisateur en fonction des circonstances et des règles applicables.
Il est recommandé au participant de ne pas participer à l’événement en cas de symptômes rappelant ceux d’une maladie infectieuse, comme un état grippal, de la fièvre, une toux, un essoufflement, un nez qui coule ou une fatigue inhabituelle.
Il n’est pas recommandé aux groupes à risque de participer à l’événement.
Article 9. Assurance – Force Majeure – Responsabilité
Les accidents personnels (dommages corporels) des participants à l’événement sont couverts par l’assurance accident collective incluse dans les frais d’inscription.
Constitue un cas de force majeure tout événement indépendant de la volonté et du contrôle de l’organisateur et auquel celui-ci ne pouvait raisonnablement s’attendre, et qui l’empêche (même temporairement) d’exécuter tout ou partie de ses obligations. Cela comprend (non exhaustif), les instructions, les décisions ou les interventions de quelque nature que ce soit d’une autorité publique, administrative ou réglementaire («fait du Prince»), le terrorisme ou la menace terroriste, conditions météorologiques (telles que chaleur extrême, orage, tempête, rafales, inondations, etc.), incendie, émeute, guerre ou menace de guerre, insurrection, épidémies, pandémies (comme Covid-19) ou autres maladies contagieuses, état de quarantaine, ), la non-livraison ou la livraison tardive ou les erreurs des fournisseurs ou d’autres tiers engagés (à l’exclusion de leur faute intentionnelle et de leur négligence grave), perturbations dans un réseau ou une connexion (télécommunications) ou systèmes de communication utilisés, émeutes sur la voie publique, les barrages, les grèves ou les lock-out, les manifestations et autres perturbations inquiétantes. L’organisateur n’est pas responsable des cas de force majeure, qui ne donnent pas droit au remboursement des frais d’inscription ou à toute autre forme de compensation. En cas de force majeure, l’organisateur examinera dans un délai raisonnable s’il est possible de dédommager le participant – par exemple en échangeant le billet contre un billet pour la nouvelle/prochaine édition de l’événement ou pour un autre événement de GOLAZO – en fonction des circonstances. Tous les autres frais engagés dans le cadre de l’événement, tels que les frais de service et d’administration et les frais supplémentaires (tels que le marchandisage, les t-shirts, le programme d’entraînement, la charité, etc.), ne seront pas remboursés.
GOLAZO n’est responsable que d’une faute qui lui est imputable. Si la responsabilité de GOLAZO est engagée pour des dommages, l’obligation de GOLAZO de réparer les dommages sera limitée au maximum au montant payé pour les services fournis, à savoir les frais d’inscription, à l’exclusion des dommages indirects (y compris les dommages consécutifs, la perte de profits ou la perte d’opportunité, etc.) Cette limitation de responsabilité ne s’applique pas en cas de dommages causés par une faute intentionnelle, une négligence grave et/ou fraude de GOLAZO, ou pour toute autre responsabilité qui ne peut être exclue ou limitée en vertu de la loi applicable.
Le participant renonce à une réclamation extracontractuelle directe contre les auxiliaires de l’organisateur (y compris les directeurs, les employés, les représentants et les indépendants) au sens de l’article 6.6 du Code Civil en cas de faute des auxiliaires pouvant donner lieu à une telle réclamation telle que visée à l’article 6.3 du Code Civil, et se tournera exclusivement vers GOLAZO pour tout dommage subi. Cette renonciation à recours ne s’applique pas en cas de faute intentionnelle, de négligence grave et/ou de dol des auxiliaires, ou si le manquement constitue une infraction pénale.
En cas d’annulation de l’événement par GOLAZO, hors les cas de force majeure, le billet sera échangé contre d’un billets pour une nouvelle/prochaine édition de l’événement ou un autre événement de GOLAZO.
Article 10. Données à caractère personnel
Toutes les données relatives aux participants sont destinées à GOLAZO. GOLAZO et ses partenaires vont utiliser ces informations pour la participation à l’événement ainsi que pour des fins de marketing et de communication. Le Règlement Général sur la Protection des Données 2016/679 relative à la protection de la vie privée à l’égard des traitements de données à caractère personnel prévoit le droit d’accéder aux données et de les rectifier. Le participant peut demander à tout moment la rectification de ses données à caractère personnel, en utilisant les données de contact reprises dans les présentes conditions générales.
En participant à l’événement, vous acceptez une utilisation éventuelle de vos données, de votre photo ou de vos droits à l’image sous une forme imprimée, cinématographique, vidéographique ou autre, à des fins promotionnelles au profit de GOLAZO et de ses événements, sans réclamer d’indemnité à cet égard.
Le participant déclare savoir qu’il peut être fait usage de techniques permettant de détecter à tout moment sa localisation précise par réception des signaux émis par la puce intégrée dans la preuve de participation que porte le participant. Le participant autorise GOLAZO à divulguer cette information afin que chacun puisse la consulter.
Le participant donne à GOLAZO l’autorisation de suivre sa localisation en temps réel (traçage en direct) d’une manière définie plus haut, pour enregistrer ces données dans un fichier, les remettre à des tiers et les publier sur l’Internet, par le biais de médias sociaux et d’applications mobiles.
Article 11. Remarques/plaintes
Les remarques doivent être envoyées par l’un des canaux mentionnés en introduction. GOLAZO s’efforcera toujours raisonnablement de traiter chaque remarque reçue dans les 10 jours suivant sa réception par le biais de l’un des canaux précités. Si elle n’y parvient pas, GOLAZO le signalera au participant et lui proposera un autre délai.
Article 12. Validité des clauses
Si un ou plusieurs articles des présentes conditions sont nuls ou illégaux, quelle qu’en soit la raison, cela n’affectera pas la validité des autres articles des présentes conditions générales.
Article 13. Droit applicable – Juridiction
Le droit belge s’applique aux présentes conditions générales. En cas de litige concernant ces conditions générales, seuls les tribunaux de la juridiction du siège de GOLAZO sont compétents.

Article 1. Registration
At the time of registering, the participant declares to be at least 18 or to have his legal guardian’s consent to register for the event.
The registration is only valid if the registration form has been completely and truthfully filled out, the registration fee and payment for extras have been paid in full and these general terms and conditions have been accepted.
Article 2. Right of withdrawal
The registration falls under Art. VI, 53, 12° WER for which the right of withdrawal is excluded. In case of non-participation, regardless of the reason, the registration fee and possible extras cannot be reclaimed.
Article 3. Storage space
Participation in an event and entering the event area is at the participant’s own risk. The organiser may provide a storage space where the participant may leave personal belongings, without obligation and free of charge. The organiser will take all reasonable safety measures to guard the storage space, however use is at the participant’s own risk. The organiser discourages the participant to bring or store valuable items. The organiser shall not be liable in any case for damage, loss or theft of property of the participant.
Article 4. Participation
Participation in an event is only possible with a valid registration and compliance with the age requirements. The organiser reserves the right to exclude participants from participation who do not respect the provisions of these general terms and conditions or pose a danger to themselves or third parties.
Different age requirements may apply for certain events, and the applicable regulations for the event should be consulted on the event website.
Walking events
Participants under the age of 12 years must always be accompanied by a person older than 18.
From 25 km: at least 12 years old at the time of participation

Cycling events
Participants under the age of 16 must always be accompanied by a person older than 18.
The participant shall at all times wear a helmet during cycling events. The Highway Code needs to be respected.
During the participation, proof of registration (number on chest, handlebars, wristband, etc.) must be visible at all times.
The participant shall always respect the environment. The participant shall look after his/her own safety and the other participants. Participants must follow the instructions of the organiser, medical teams and police.
Article 5. Prices
The specified prices are always in Euros and inclusive of VAT, unless explicitly specified otherwise.
Article 6. Payment
Upon registering, the participant must pay the full amount of the registration (registration fee and extras) using the provided online payment system.
Article 7. Change of registration
Participants who want to transfer their registration for an event to another person may do so by contacting GOLAZO by telephone (every working day between 9 a.m. and 5 p.m. on telephone number 011/45.99.00) or on site on the day of the event. In case of change of registration on site, the participant shall be due an administrative cost.
Participants who want to change the distance may, in case the desired distance is not sold out, do so by contacting GOLAZO by telephone or on site on the day of the event. In case of change of distance on site, the participant shall be due an administrative cost. If a supplement is due for the newly chosen distance, this will also be charged the participants.
It is not possible to exchange a registration for an event for another edition of that same event, nor for another event of the organiser. Any minus price is not eligible for a refund as a registration is not revocable.
Article 8. Healthy & safe sports
Participation requires good health and good conditional preparation. The participant declares to meet this condition. Before participation, the organiser recommends a preventive sports medical examination at a certified sports doctor.
The organiser has taken the necessary health and safety precautions for the event. The participant undertakes to strictly comply with the applicable measures, which can, at any time, be adjusted by the organiser to the circumstances and to the then applicable regulations.
It is recommended that participants do not take part in the event when showing symptoms that might indicate an infectious disease, such as feeling feverish, fever, cough, shortness of breath, running nose or unusual fatigue.
Risk groups are recommended not to take part in the event.
Article 9. Insurance – Force Majeure – Liability
Personal accidents (physical damage) of participants in an event are covered by a collective accident insurance included in the registration fee.
Any occurrence that takes place beyond the will and the control of the organiser, and which the organiser could not have reasonably expected, and which prevents the organiser (even temporarily) from fulfilling its obligations in whole or in part, constitutes a situation of force majeure. This includes, but is not limited to, instructions, decisions or interventions of any kind by public, administrative or regulatory authorities (“fait du Prince”), terrorism or the threat of terror, weather conditions (such as extreme heat, thunder, storm, gusts of wind, floods, etc.), fire, riot, war or threat of war, uprising, epidemics, pandemics (such as Covid-19), state of quarantine, non-delivery or late delivery or errors of suppliers or other third parties engaged (excluding their willful misconduct and gross negligence), disruptions in a (telecommunications) network or connection or used communication systems, riots on the public highway, blockades, strikes or lock-outs, demonstrations and other disruptive disturbances. The organiser shall not be liable for cases of force majeure, which do not entitle the participant to a refund of the registration fee or any other form of compensation. In cases of force majeure, the organiser will consider within a reasonable time whether any compensation for the participant – e.g. exchange of the ticket for a ticket of the new/next edition of the event or other event of GOLAZO – is possible, depending on the circumstances. Any other costs incurred in connection with the event, such as service and administration costs and any extras (such as merchandising, T-shirts, training schedule, charity, …) are not eligible for reimbursement.
GOLAZO shall be liable for defaults attributable to it. If GOLAZO’s liability for damage is to be assumed, GOLAZO’s obligation to compensate for the damage shall be limited to maximum the amount of the fee paid for the services provided, i.e. the registration fee, with exclusion of indirect damage (including consequential damage, loss of turnover or profit or missed opportunities, etc.).The limitations of liability as specified herein shall not apply in the event of damage caused by an intentional error, gross negligence and/or fraud on the part of GOLAZO or for any other liability which cannot be excluded or limited under applicable law.
The participant waives a direct extra-contractual claim against the organiser’s auxiliary persons (including directors, employees, representatives and freelancers) within the meaning of Article 6.6 of the Civil Code in the event of errors on the part of auxiliary persons which could give rise to such a claim as referred to in Article 6.3 of the Civil Code, and will turn exclusively to GOLAZO for any damage suffered. This waiver of claim shall not apply in case of intentional error, gross negligence and/or fraud of the auxiliary persons, or if the default constitutes a criminal offence.
In case of cancellation of the event by GOLAZO, other than in the event of force majeure, the ticket will be exchanged for a ticket for a new/next edition of the event or another GOLAZO event.
Article 10. Personal data
All information of the participants is for GOLAZO’s administration. GOLAZO and her partners will use the information for purposes of subscription to the Event and marketing and communication purposes. The General Data Protection Regulation 2016/679 relating to data processing lays down the access right to the data and the correction thereof. At all times the participant can request the correction of his/her personal data based on the contact details specified in these general terms and conditions.
Through your participation to the event you declare you agree with a possible use of your details, photograph or portrait right in print, film, video, etc. for promotional purposes of GOLAZO and its events, without claiming payment for this.
The participant states he/she is familiar with the fact that techniques may be used that allow his/her exact location to be tracked at any moment by picking up signals of the chip, included in the proof of participation which the participant is wearing. The participant gives consent to GOLAZO to make this information public so that it can be viewed by everyone.
The participant gives consent to GOLAZO to track his/her location real-time (live tracking) as described above, to save this data in a file, to provide it to third parties and to publish it online, through social media and mobile applications.
Article 11. Comments/complaints
Comments need to be submitted via one of the channels specified in the heading. GOLAZO shall always, in all reasonableness, try to treat every comment within 10 days upon receipt through one of the aforementioned channels. If this is not possible, it shall also be notified to the participant and an alternative timing is suggested.
Article 12. Validity of clauses
If one or a number of articles of these conditions are void or unlawful, for whatever reason, this does not prejudice the validity of the other parts of the conditions.
Article 13. Applicable law – Jurisdiction
These general conditions are governed by Belgian law. Any disputes arising from these general conditions fall within the exclusive jurisdiction of the competent courts of the registered office of GOLAZO.
